Types of Debt

 

Consumer Debts

Consumer debts (B2C) are defined as debts created by individuals and households as a result of the consumption of goods and services from firms such as credit companies, insurance agencies, banks, schools and institutions of higher education, communications and media companies, car rentals, medical institutions and other organizations.

Consumer debt collection requires the ability to manage effectively a large number of claims. This is achieved by state-of-the-art technological tools, latest communications infrastructure, professional collection teams who have the necessary knowledge of psychology required for the art of persuasion, and withstanding pressure. 

The office staff specializes in insistent consumer debt collection while simultaneously trying to retain the debtor as a future customer in competitive market conditions.

Commercial Debts

Commercial debts (B2B) are debts generated by commercial organizations as part of their contractual arrangements and are characterized by higher debt totals.

The complexity of managing commercial debt cases requires the office to have proven comprehensive legal knowledge, strong legal litigation skills and negotiating abilities. When the amount of the debt justifies it, a financial investigation of the debtor is carried out in order to assess his ability to settle the debt as well as to discover assets that can be seized.   

The office's legal department provides its clients with over 25 years of experience and expertise in commercial litigation. The department assesses the chances of collection and decides on the preferred legal procedures based on the most effective legal strategy. This strategy may include the implementation of fast interim remedies including such as the freezing of assets or preventing the debtor from leaving the country. Once a judgment has been handed down, the legal department will transfer the  management of the case to the debt collectors who will adopt all available measures and supervise proceedings until the debt has been collected. 

 

 

Did you know? The total amount of debts handed over to collection by the Judgement Enforcement Department of the Legal System in Israel during 2009 stood at NIS 15,000,000.

 

Public Sector Debts

Public sector debts are debts incurred by government bodies, and local government such as taxes, fees, levies and fines as well as debts owed to the authorities following legal disputes with other parties.

In Israel, the government and local authorities benefit from the ability to implement Administrative Collection without resorting to the courts. This procedure allows for the generation of fast collections but creates image problems for the authorities, who are sensitive to criticism regarding the level and nature of services provided to citizens.
 

Types of Proceedings

Pre-legal proceedings

Demand letters formulated together with the client and taking into account his  policies are sent to the debtors while at the same time persistent telephone contacts are made. 

Legal Collection

The office's legal department files lawsuits and appears in all courts in the country regardless of location. As part of the lawsuits and whenever necessary, interim remedies are submitted such as foreclosures of bank accounts + property and chattel, injunctions, motions for prohibition of leaving the country, temporary receivership, Anton Piller orders and Mareva injunctions.

The Court System Judgment Enforcement Department

Following the receipt of the Court's judgment, our office opens the enforcement file with the Judgment Enforcement Department of the Courts and closely overseers the various collection procedures.

The proceedings that can be carried out (sometimes ex parte and before any warning has been received by the debtor) include: foreclosures seizures, confiscation of property and vehicles, injunctions prohibiting exit from the country, prohibitions of driver's license, orders to pay, obtaining information from government authorities, garnishing wages, third party seizures and even debtors imprisonment (pursuant to fulfillment of appropriate conditions).

Receivership and Liquidations

Under appropriate circumstances, our office files motions for bankruptcy, receivership and liquidation of companies.

Administrative Collections

Our office carries out administrative collection on behalf of government authorities and government entities. This collection is not managed through the courts but in compliance with the provisions of the Israeli Tax Ordinance (Collections).

Debt Collections in The Occupied Territories

Debt collection in The Occupied Territories involves numerous difficulties due to both language barriers and its undefined final political and administrative status.

Isaac Eilat Law Offices works in conjunction with the law enforcement and debt collection State authorities in such cases where they are authorized to issue documents as part of debt collection proceedings against residents in the Occupied territories. It should however be clarified that debt collection proceedings can only be carried out regarding the debtor's assets that are registered in Israel. In order to provide a complete solution to clients when debt collection is required from a debtor whose assets are not registered in Israel, our office works with leading debt collection agencies around the world and in the West Bank.
